Why Seniortours  
Please familiarize yourself with the important information below. Your understanding of policies and procedures will enhance the comfort and enjoyment of your Seniortours vacation.
 

Seniortours is the sole owner of the information collected on this site. We will not sell, share or rent this information to others in ways different from what is disclosed in this statement. We are committed to strictly controlling the use of any information you provide to Seniortours, including personal and financial information necessary to book a Seniortours vacation.
Sharing your Information


When you reserve or purchase travel arrangements through Seniortours, we provide some information about you (such as name) to airlines, hotels or other third parties involved to ensure the successful fulfillment of your travel arrangements. We do not sell, or dispense for our profit or the profit of others, individual customer names or other private profile information to third parties. The information we provide to such third parties is protected by a confidentiality agreement and is to be used solely for completing a specific project. The sharing of personal information to airlines and hotels is necessary to provide travel arrangements.

This web site contains links to other sites. Please be aware that Seniortours is not responsible for the privacy practices of other sites. We encourage our users to read the privacy statements of any website that collects personally identifiable information. The Seniortours.com privacy statement applies solely to information collected by the Seniortours.com website.


In addition to our online privacy practices, all passenger information, not just the sensitive information mentioned above, is restricted to secure areas of the Seniortours offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information. All employees are kept up-to-date on our security and privacy practices. Any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure that our customers' information is protected.

Notification of Changes

If we decide to change our Privacy Policy, we will post those changes on the website so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use personal identifiable information in a manner different from that stated at the time it was collected, we would notify users by way of email. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the Privacy Policy under which the information was collected.


Other Information about Privacy


Seniortours.com may disclose member information if required to do so by law, court order, as requested by other government or law enforcement authority, or in the good faith belief that disclosure is otherwise necessary or advisable including, without limitation, to protect the rights or properties of Seniortours.com or when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or properties, whether intentionally or otherwise, or when anyone else could be harmed by such activities.

Terms and Conditions

Reservations and Payments (Escorted Tours)


In order for Seniortours to hold a reservation, a deposit is necessary. Unless otherwise noted, the amount of this deposit is $100 per person. Reciept of this deposit ensures that Seniortours will only hold a reservation on your behalf. With the exception of medically necessary arrangments, seat assignments and special requests can not be honored until receipt of payment in full. Seat assignments and special requests are honored by the order in which each passenger's full payment is received.

Any person or entity, including a travel agent, with whom you deal other than Seniortours in purchasing this tour acts strictly as your agent in dealing with us. Accordingly, we disclaim liability for payments made to anyone until we receive such payment earmarked for your account and we accept it as such.

Prices


All prices are subject to increase due to any increase in our costs, such as, but not limited to: increases in air, land or sea fares, fuel costs, and currency fluctuations. Unless otherwise noted, all taxes, fuel surcharges, security charges and any other taxes or charges imposed by airlines, airports, cruise lines, government, etc. are not included in the price.
Gratuities not specifically mentioned are excluded.


Tour members who have not made air or transportation arrangements via Seniortours, including those arriving early or extending their stay in a cruise port, must arrange their own transportation from airport to hotel and hotel to airport.


Unless otherwise noted, the costs of optional activities, including, but not limited to: car rentals, hotel facility charges, meals not included in tour/cruise packages, shore excursions, theme park tickets, additional transportation including taxi and transfers not included in tour/cruise packages, and any and all other entertainment or leisure activities not included in tour/cruise packages, are your sole responsibility. Seniortours is unable to reimburse passengers for the cost of the above activities. With the exception of a personal medical emergency, Seniortours is unable to reimburse passenger(s) for any portion of a tour/cruise package, including but not limited to meals, entertainment, theme park admission, and other activities included as part of a tour/cruise package, if passenger(s) voluntarily opt-out of participation in said activity; missed meals/shows/admissions, etc. are included in this policy due to the cancellation agreements between Seniortours and the appropriate third party providers. No refund will be made for any accommodations or services included in the tour that you do not use.


Errors


In case of printing typographical error, computer error, or human billing error, we reserve the right to invoice or re-invoice participants with corrected billing.


Ticket Revision/Cancellation Fee


Cruise and air tickets are governed by the cancellation policy of the appropriate provider. Seniortours is unable to make revisions to these policies. As such, it is your responsibility to familiarize yourself with the appropriate timelines and charges/fees associated with changes and cancellations for cruise and air tickets. In some cases, late changes and/or cancellations are not covered by travel insurance and might result in forfeiture of all or a substantial portion of your payment. Please consult the appropriate documentation for further details. Seniortours is not responsible for any monies lost as a result of passenger noncompliance with the stated cancellation and change policies of third party providers, including insurance providers, even if you purchased your insurance through Seniortours.

Gratuities Not Included


The customary gratuities to your personal tour escort and tour drivers are not included and should be extended on a voluntary, individual basis and not as a group. Customary guidelines for Seniortours' traditional excellent service are $3-$4 per person, per day for tour escort and, when applicable, motorcoach driver.

Substitutions


We reserve the right, at our sole discretion, to substitute carrier, aircraft, charter flight for scheduled flight, cruise line, and to alter the itinerary, substitute portions of the sightseeing, ports of call, entertainment, hosts, entertainers, hotels, restaurants, party and banquet locations, or other accommodations.

Holidays and Changes


During local or national holidays abroad, certain facilities such as museums, sightseeing tours and shopping may be limited. In such instances, and whenever possible, slight itinerary adjustments are made by Seniortours to minimize inconvenience to tour members. If, however, your enjoyment might be diminished by such minor limitations, please check with the appropriate tourist office before selecting a departure. Holidays, closing days and other circumstances may change the day of the week for scheduled "dining out", sightseeing and other activities.

Travel Documents


United States citizens require a valid passport only, when they travel to Europe, Mexico, Canada, and other international destinations. Non-citizens have other specific requirements which should be checked immediately.

Baggage & Insurance


Unless otherwise noted, each tour passenger is limited to one large suitcase and one small carry-on bag. Medically necessary equipment and/or paraphenalia do not count against this limit, and, in the case of motorcoach tours, can be carried on and off the coach as needed. Airlines and cruise lines routinely charge extra fees for overweight luggage and additional baggage. It is your responsibility to determine which, if any, of these fees might apply to you. Seniortours is not responsible for the payment of any additional third party fees resulting from your decision to carry additional and/or overweight baggage. There is no weight limit for motorcoach only tours, unless stated otherwise.

Seniortours is unable to take responsibility for lost or damaged luggage.

Hotel Accomodations


The hotels listed in this site will be used on almost all departures. If a change becomes necessary for any reason, the hotel substituted will be the equivalent of those shown.
Single rooms - A limited number of single rooms are available at the supplement rate shown for each tour. While single rooms provide privacy, they are often smaller than twin bedrooms and sometimes poorly located, especially in older hotels.

Shared rooms - If you are traveling alone but prefer to share with another, we will try to work out congenial rooming arrangements. If a single room must be assigned due to your roommate's cancelling or incompatibility or for any other reason (even at the last moment or while on tour), we must, of necessity, charge you the tour's single supplement or prorate thereof since the hotels make no allowances.

Triple/quad rooms are available on some tours. Seniortours can only guarantee that these rooms consist of two double beds. Often, fire regulations or other local codes prohibit the use of a cot/rollaway bed for 3rd or 4th guests. As such, those passengers who book tours at the lower triple/quad rate should be aware that private beds for all passengers rooming together are not always available. Seniortours is unable to move passengers booked as part of a triple/quad into single or double rooms or into larger rooms to accommodate separate bedding needs.
We're happy to inform the hotels of any special requests, such as "king bed", "lower floor", etc., provided we are advised at time of booking. Such requests can not be guaranteed as availability is often limited.

Cancellation and Insurance


Our famous "No Worry" Refund Cancellation Policy (and more): Up to 72 hours prior to your departure, if you must cancel your all motor coach tour because of a medical problem involving you, your roommate, or immediate family member, Seniortours will refund 100% of your payments, excluding any nonrefundable charges from hotels or other suppliers. Cancellations within 30 days of departure which are not due to medical reasons are subject to a $100.00 per person administrative fee. On motor coach tours, there is never a penalty for a cancellation more than 30 days prior to departure.

Optional cancellation, trip interruption, luggage, and medical insurance is available and recommended. As stated above, cancellation refunds for vacations involving airlines or cruises vary, and penalties may be applied by the cruise line, airline, or tour operator. Please make sure that you are aware of the cancellation policy of your particular cruise or tour. If you must interrupt your trip, we regret that tour suppliers (hotels, restaurants, transportation companies, etc.) will often withhold all or a substantial portion of payments. While Seniortours will seek to secure any reimbursement possible, such reimbursements generally represent only a fraction of your payments. Seniortours Inc. acts as agent only in providing and arranging all tour services, and assume no responsibility for injury, damage to luggage, loss, theft, accident or delay due to the act or default of any company or person engaged in transporting its tour patrons or providing other services. Every booking is accepted subject to the conditions imposed by these independent contractors, including the air, cruise line, coach, hotel, restaurant, and other companies firms, or persons concerned with the tour. Supplemental travel insurance is available from Seniortours if requested. Seniortours reserves the right to cancel or modify any tour upon advance notice, and will return all moneys paid in connection with such cancelled tours.

Proof of Claim


Claim of illness or injury must be strictly valid and supported by the submission of a detailed medical certificate signed by a board certified physician with the full specificity of law. In case of death, a death certificate with raised seal is required.

Refund


All refunds are conditioned upon your understanding that your acceptance of a refund is on the express condition that you release us from all further liability and you thereby waive all additional rights and remedies under this contract or any applicable state, federal or foreign law.

Arrive Early - Extend Your Stay


If you have arranged with us to arrive early or remain after the termination of your tour, please understand your stay and your airport transfers will be at your sole expense, unless stated otherwise.

Check with Seniortours for special discount room rates. Extra nights are based on availability.

Right To Exclude


We reserve the right in our sole discretion, acting in good faith, to decline to accept or to require any individual to withdraw from any tour. This refers to persons who are abusive of others or whose behavior disrupts the operation of the tour.

Tour Members Needing Special Assistance


Seniortours makes every attempt to make all our guests comfortable, but we regret that we cannot guarantee to provide individual assistance to a tour member for walking, dining, getting on and off motorcoaches and other transportation vehicles, or other personal needs. Travelers who need such assistance must be accompanied by a qualified companion. Remember that Seniortours vacations (excluding, unless otherwise noted, third party providers) are designed with seniors in mind, and as such generally require minimal walking and limited physical activity. If you have a question as to the specific physical requirements of a given tour, please call us in advance to discuss your options.

Smoking


Smoking on the motorcoach is not allowed. However, regular stops are scheduled for those who wish to smoke. Seniortours does not guarantee that smoking rooms will be available at all properties or that any passenger will have the opportunity to purchase and/or replenish their personal supply of tobacco products during their Seniortours vacation.

Responsibility


Seniortours, Inc., its and their employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, and assigns (collectively "Seniortours"), does not own or operate any entity which is to or does provide goods or services for your trip including, for example, lodging facilities, airline, vessel, motorcoach, or other transportation companies, guides or guide services (with the exception of Seniortours escorts), local ground operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors. As a result, Seniortours is not liable for any negligent or willful act or failure to act of any such person or entity or of any third party. Tour members are also subject to the terms and conditions set forth on their airline, rail or cruise line ticket. These conditions are available upon request.

You may see the name Seniortours affixed to motor vehicles, on signs around the hotel or elsewhere. This use of our name is purely for reasons of identification and does not denote ownership, supervision, or control by Seniortours in any way.
In addition and without limitation, Seniortours Tours is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also be advised that foreign air-conditioning systems in public places, hotels and motorcoaches are not up to U.S. standards.

If due to weather, flight schedules or other uncontrollable factors you are required to spend an additional night(s), you will be responsible for your own hotel, transfers and meal costs. Baggage is entirely at owner's risk. The right is reserved to decline to accept or retain any person as a member of these trips at any time. In any such event, Seniortours' sole obligation is to refund for any unused accommodations or other trip features. Passenger certifies not to have any mental, physical or other condition or disability that would create a hazard for himself/herself or other passengers.

Seniortours reserves the right to change the itinerary or trip features at any time and for any reason, with or without notice and/or to substitute, airlines, hotels of a similar category for those listed in this website, and Seniortours shall not be liable for any such changes.
From time to time a tour departure may be cancelled for lack of participation. In such a case, the operator's sole responsibility is to provide a refund without any other liability whatsoever. Operator further will have no responsibility for any conjunction tickets, non-refundable or otherwise.

By your knowing the above, you can purchase optional, recommended trip insurance and there will be no misunderstanding before, during or after your vacation.

Arbitration Agreement


Any controversy or claim arising out of or relating in any way to these Terms and Conditions, to the Responsibility Clause, to the brochure, to the website, or any other information relating in any way to the trip, or to the trip itself, shall be settled solely and exclusively by binding arbitration in New Jersey, in accordance with the commercial rules of the American Arbitration Association then existent. Upon payment of a deposit, tour participant indicates acceptance of the above Terms and Conditions and of the Arbitration Agreement.

Operator - Tour Member Participation Agreement


Further information concerning the conditions of the tours is contained in an agreement that will be signed between the tour member and tour operator at the time of tour deposit.

Contests and Promotions

From time to time, Seniortours, Inc. may choose to offer certain promotions, games, or contests ("Contest(s)") to its passengers and web site visitors. Full Contest rules will be posted here. Contests begin and end at the discretion of Seniortours management. Where not specifically mentioned below, Contests are governed by the laws of the United States and the laws of the state(s) in which Contest participants primarily reside.


The Seniortours Facebook Photo contest
("the Facebook Contest") is open to all legal residents of the United States. No purchase necessary to enter. Contest begins August 22, 2011 (8/22/2011) and ends on or about January 1, 2012 (1/1/2012). Ten (10) winners will be chosen by Seniortours staff and will each receive one (1) Seniortours Gift Certificate valid for one (1) year from the award date. Gift Certificates are non-transferable and are redeemable toward the purchase of any Seniortours "classic" motorcoach vacation of five (5) days or more. Gift Certificates are not vaild toward the purchase of cruise vacations, day trips, shore excursions, or admission to any third party theme parks, sights, restaurants, or facilities. Limit one gift certificate per person per vacation. Photos must be submitted via the official Seniortours Vacations Facebook page ("the Page"), located at http://www.facebook.com/seniortours. Submissions made via email, "snail" mail, or via any medium other than the Page will not be judged. Seniortours employees and their families are not eligible to participate in the Facebook Contest.

Should fewer than ten (10) photos be submitted, the decision to award prizes will be at the discretion of Seniortours management. No guarantee is made that every photo will be considered for an award.

Unacceptable Material: Photos containing questionable content, including, but not limited to content that, as defined by the laws of the United States and the standards of the community(-ies) in which Contest participants reside, is illegal, immoral, or objectionable will not be judged and will be removed from the Page. Anyone attempting to submit illegal, immoral, or objectionable material, henceforth referred to as "unacceptable material," as defined above, below, and also by the standards of Seniortours managment, will face the appropriate penalties, including disqualification from this and future Contests and legal action where appropriate. Each submitted photograph must contain the undoctored, unmanipulated image of the person submitting the photograph. No stock photography, copyrighted imagery, copyrighted photographs, photo illustrations, or otherwise doctored or manipulated images will be accepted. In the case of stock photography, copyrighted photographs, and copyrighted imagery, should your submission of unacceptable material, including material incorrectly deemed by Seniortours to be admissble and not unacceptable, result in financial, repulational, or operational damages to Seniortours, you agree that you will be held responsible for all such damages, including, but not limited to, legal fees, attorney fees, court-imposed fees, and all fees, fines and other monies payable to legal copyright holders, artists, photographers, photo clearinghouses, and any and all additional claimants.

Binding Arbitration: Your participation in the Facebook Contest hereby waives your right to a jury trial for any and all damages occuring as a result of your participation. In the case of damage(s) to Seniortours' business or reputation, you agree that any action on your behalf that results in any loss of income to Seniortours will be subject to legal action, and that all decisions with regard to your actions will be made by an arbitrator chosen by Seniortours. You agree that the decisions made by this arbitrator are binding and final. Independent of the result of said arbitration, you also agree to pay a minimum fee to Seniortours in the amount of two hundred and fifty thousand dollars (USD$250,000) as compensation for lost income and/or damage(s) inflicted on the operations of Seniortours and/or the reputation of Seniortours, its affiliates, and its staff resulting in loss of income.

Waiver of Copyright and Financial Compensation: All photos submitted to Seniortours via the Seniortours Vacations Facebook page become property of Seniortours, Inc. and can be used for promotion, marketing, and branding, including, but not limited to, placement and/or usage on web sites, flyers, booklets, postcards, marketing materials, and other material produced by Seniortours and its affiliates. By submitting a photograph, you agree to vacate all claims of copyright for that photograph. Your participation constitutes your understanding that Seniortours will not and can not compensate you for your submission and/or participation in any way beyond the aforementioned prize(s), the awarding of which is governed by the aforementioned rules and terms.

By "liking," "friending," or otherwise interacting with the Page, you agree not to hold Seniortours responsible for any and all damages arising from said interaction, including, but not limited to, damage to computer software or hardware, identity theft and damages arising from identity theft, loss of privacy, and/or any and all additional financial, reputational, or psychological damages. Seniortours does not own, materially manage, or host the Page, and, as such, the Seniortours privacy policy does not apply. Please familiarize yourself with the privacy policies of third party vendors, web sites, hosts, and any and all additional third party affiliates, including, but not limited to, Facebook, Yelp, TripAdvisor, etc.
